A Will is important. In these modern times of law suits and claims against Estates. Proper preparation is more important then ever. There was a time when a handshake, someone's word and common sense ruled, making dealing with others simple straightforward and honest. These days you must have a contract because we have lost our sense of fairness and justice and replaced it with “Is it legal?” Your final wishes put down on paper are your contract with the government. They are to make sure your final wishes are adhered to. Stating your final wishes: - reduces confusion and uncertainty.
- provides reassurance to the family.
- names your executor and asks them to act immediately - making funeral arrangements and looking after issues surrounding your Estate.
- protects your assets and ensures they are dealt with as you have directed.
- Permits arrangements to be made, in the best interest of minor children, other dependents and pets.
- Clarifies for family and friends your wishes and who is to carry them out.
- Minimizes the costs of dealing with your estate and the effort involved in managing it.
Setting it up need not be complicated or expensive. Having them written down is smart and well worth the cost. Ask yourself what would happen if you died tomorrow? What if your spouse died? What if you and your spouse died together? These are questions you need to address properly. It’s smart to review your situation every time there is a change in your life. For example: - can your chosen executor still manage your estate?
- have you been divorced?
- married?
- remarried?
- has a child has been born into your family?

Choosing Your Executor
Choosing your executor is important. This should be someone you trust implicitly.
People tend to choose their spouse, their parent, an adult child or trusted friend. Some people choose a professional such as a lawyer or trust company.
Whatever you do, always make sure the person you plan to appoint as executor is able and willing to act. There is nothing worse - than a close friend receiving a phone call - being stunned to learn of your loss and,
“Oh yeah, by the way, John you are the executor.”
Once it's prepared, tell your executor where it’s kept along with other important documents, Life Insurance, deed to house etc. Make known the kind of funeral you want to have with your executor and family.
Make a list of the names addresses and telephone numbers of anyone who is named in the Will and keep that list with the important documents.
The executor is entitled to be paid for the work they do. Many executors feel guilty about taking any money from the Estate and forgo any payment, costing themselves serious money. Let all parties involved know that you wish the executor to be reimbursed for their time and money.
